  4. We were discussing what action of ripping DVDs was illegal. I brought up the fact that the Digital Millennium Copyright Act (DMCA) prohibits breaking encryption, in order to create a copy (whether it be for backup or not), as one of its main clauses.

    Mark retorted that his software takes care of decrypting for him and doesn’t alert him with the status of the encryption on the DVD that is being ripped so he cannot be held responsible.

    I suggested that since most DVDs are encrypted he should have a reasonable assumption that his software was defeating the encryption measures and he was therefore performing an illegal action.
